Terms and Conditions

These Terms and Conditions apply to every consulting engagement undertaken by Her Legacy Consulting, whether a single paid consultation or a longer scope of work covering strategy, operations, financial systems, or leadership development. They are separate from our Website Terms of Use, which govern browsing this website rather than the delivery of consulting services.

Her Legacy Consulting provides business consulting services, including business strategy and growth planning, operations and standard operating procedure development, financial systems and compliance support, and leadership development for women in business. The precise scope of any engagement beyond the initial consultation is agreed in writing between Her Legacy Consulting and the client before work begins.

Her Legacy Consulting provides business consulting only. Where an engagement identifies a need for regulated accounting, tax, legal or other professional services, Her Legacy Consulting will work alongside, or refer the client to, appropriately qualified and registered professionals for that regulated work. We do not present regulated professional services as our own, and nothing in an engagement with us should be treated as accounting, tax or legal advice.

Following an initial consultation, we may provide a written proposal setting out the recommended scope of work, deliverables, timeline and fees for a longer engagement. An engagement beyond the initial consultation begins once that proposal has been accepted by the client, whether by written confirmation or by payment of the agreed fee.

A paid business consultation of thirty minutes is offered at a fee of R500, payable in advance of the consultation unless otherwise agreed. Fees for any further scope of work are set out in the relevant proposal and are payable on the terms stated in that proposal, which may include a deposit before work begins and staged payments linked to milestones.

Fees quoted are for the consulting services described in the applicable proposal and do not include third party costs, such as fees payable to an accountant, attorney or other regulated professional to whom a client is referred.

We understand that plans change. A consultation may be rescheduled by giving reasonable notice through our consultation form. Where a consultation fee has been paid and the client cancels with reasonable notice, we will work with the client to reschedule at no additional cost. Fees are not ordinarily refundable where a client fails to attend a scheduled consultation without reasonable notice.

For longer engagements, either party may terminate the engagement on reasonable written notice as set out in the relevant proposal, without prejudice to fees already earned for work completed up to the date of termination.

The value of our recommendations depends on the accuracy and completeness of the information a client provides about their business. Clients agree to provide information honestly and to the best of their knowledge, and to tell us promptly if circumstances change in a way that affects the engagement. Her Legacy Consulting is not responsible for outcomes that result from inaccurate or incomplete information supplied by the client.

Both parties agree to treat as confidential any non public business information shared during the course of an engagement, and to use it only for the purposes of that engagement. This obligation continues after the engagement ends. It does not apply to information that is already public, that was already known to the receiving party, or that must be disclosed by law.

Frameworks, templates, standard operating procedures and other materials developed by Her Legacy Consulting generally, before or independently of a specific engagement, remain the intellectual property of Her Legacy Consulting. Where such materials are customised and delivered to a client as part of an engagement, the client receives a licence to use them within their own business for as long as they need them.

Materials created specifically for a client and paid for in full as part of an engagement, such as a bespoke SOP manual built entirely around that client's operations, belong to the client on final payment, save that Her Legacy Consulting retains the right to reuse general methods, structures and non identifying know how developed in the course of that work for other clients.

Consulting recommendations are based on professional judgement applied to the information available at the time. Business outcomes depend on many factors outside our control, including market conditions and how consistently recommendations are implemented. Her Legacy Consulting does not guarantee any specific commercial, financial or operational result from an engagement.

To the extent permitted by law, Her Legacy Consulting's liability arising from any engagement is limited to the fees paid by the client for the specific engagement giving rise to the claim. Her Legacy Consulting is not liable for indirect or consequential loss, including loss of profit or loss of business opportunity, arising from a consulting engagement.

An engagement may be terminated by either party on reasonable written notice, or immediately where the other party is in material breach of these terms and fails to remedy that breach within a reasonable period after being asked to do so. On termination, the client remains liable for fees for work completed up to the date of termination.

These Terms and Conditions are governed by the laws of the Republic of South Africa, and any dispute arising from them will be subject to the jurisdiction of the South African courts.
